These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with the Cure Superfoods website (the “Service”) operated by Cure Superfoods (“us”, “we”, or “our”). Please read these Terms and Conditions carefully before using the Service.
Your access to and use of the Service is contingent upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you consent to be bound by these Terms and accept all legal consequences. If you do not agree to these terms and conditions, in whole or in part, please refrain from using the Service.

Purchases

If you intend to purchase any product or service made available through the Service (“Purchase”), you may need to provide certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You are accountable for maintaining current shipping details to ensure accurate delivery. We are not liable for any packages delivered incorrectly due to errors in the shipping details provided by the customer.

You certify and guarantee that: (i) you are legally authorized to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply is accurate and complete.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected. We will not be held accountable for any failure of the Purchase to complete, or any resulting loss or damages to you.

Cancellation Policy

Subscriptions:

You can pause or cancel your subscription at any time through your account on desktop or mobile before your subscription is due to renew. If you are uncertain about the renewal date, please contact us by email at support@curesuperfoods.ca. You are liable for all charges incurred prior to the pause or cancellation of your subscription; this includes any order(s) processed before pausing your subscription. Pausing or cancelling your subscription does not automatically terminate a processing order(s). Should you pause or cancel your subscription, we may continue to send you promotional communications unless you opt out by sending us an email.

Cancellations of your subscription must occur before your renewal date and at least 24 hours before your scheduled delivery day.

Once the subscription has been billed, the order cannot be cancelled. After the subscription order has been dispatched through our delivery partners, it is the customer's responsibility to track and receive the order. Rejecting an order for any reason does not entitle a return or refund. The Service is not accountable for delays caused by delivery personnel or courier services. The user acknowledges that unexpected events may arise and responsibility will vary based on the circumstances.

Regular Orders:

Order cancellation requests must be made at least 24 hours before your scheduled delivery date by emailing us at support@curesuperfoods.ca. We cannot cancel an order that has already been dispatched or is less than 24 hours away from the scheduled delivery day. Available options are:

• Reschedule the delivery date
• Place delivery on hold for a future date when you are available to accept the delivery
• Refund (only if requested before 24 hours of your scheduled delivery date)

Returns and Refunds

If there is a problem with a product or ingredient(s), contact us at support@curesuperfoods.ca within 48 hours of receiving your order. We require photographic evidence to support any claims. For quality-related issues regarding your order, we need photographic evidence of any product before we can issue a replacement, credit, or refund. Due to the perishable nature of our products, we are not responsible for products not consumed by the best before date and do not accept returns or issue refunds.

Complimentary Items

Items provided on a complimentary basis such as samples or promotional products are subject to availability.

Product Availability

Our website may list information about products that are not available in specific packages. If we are out of stock of one or more items, we will provide a substitute with the closest similar product available. We will inform the customer of such substitutions via email. Orders are not processed without waiting for confirmation of substitutions.

Automatic Subscription Renewal

By subscribing and agreeing to these terms during checkout, you acknowledge that Cure Superfoods is authorized to automatically bill you on a weekly or bi-weekly basis as per your chosen subscription plan. Your subscription continues until you decide to pause or cancel, or if Cure Superfoods ceases to provide access to the products or services per these terms. You acknowledge that Cure Superfoods will continue automatic payments without needing additional authorization.

Contests, Sweepstakes, and Promotions

Any contests, sweepstakes, or other promotions ("Promotions") made available through the Service are governed by rules separate from these Terms. Participation in any Promotions necessitates reviewing the specific rules as well as our Privacy Policy. If there is a conflict between the rules for a Promotion and these Terms, the Promotion rules will apply.

Accounts

When creating an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, potentially resulting in immediate termination of your account on our Service.

Communication

By using our Service, you consent to receive SMS/text messages from and on behalf of Cure Superfoods through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, discounts, early product access, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Cure Superfoods. Your participation in this program is completely voluntary. You may opt out at any time by emailing us at support@curesuperfoods.ca.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

Mobile Terms of Service

The Cure Superfoods mobile message service (the "Service") is operated by Cure Superfoods (“Cure Superfoods”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Cure Superfoods’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Cure Superfoods through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Cure Superfoods mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Lost or Stolen Packages

Cure Superfoods is not responsible for lost or stolen packages confirmed to be delivered to the address provided for the order. We are not liable for orders delivered incorrectly or lost due to incorrect shipping information provided at checkout. Please verify your shipping details carefully.

Intellectual Property

The Service and all its contents, including text, images, graphics, or code, are owned by Cure Superfoods and are protected by copyright, trademarks, database rights, and other intellectual property rights. You may display and copy, download, or print portions of the material from different areas of the Service solely for your non-commercial use, or to place an order with Cure Superfoods. Any other use is strictly prohibited and may infringe copyright, trademark, and other laws.

Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Indemnification

You agree to indemnify, defend, and hold harmless Cure Superfoods, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Service from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service.
